TERMS AND CONDITIONS
TEMPORARY / CONTRACT PLACEMENTSStaffbank Temps (SBT) provide temporary staff (Temps) to companies on Temporary / Contract with the following terms and conditions. Terms and conditions will apply to all Temp / Contract (unless it is a firm contract perm placement) assignments and any variation will be made in writing from both SBT and the Client.
The rates to be charged for a temp will be as agreed between SBT and the Client prior to each assignment, subject to rights of variation provided under this contract.
The Client undertakes to pay SBT a fee to be calculated in accordance with the following formula:
Time worked X Rate Quoted by SBT + GST
Provided that, as long as the length of an Assignment is three hours, the fee to be paid vy the client to SBT shall not be less than that which is derived by the formula when the time worked is three hours.
A charge equal to three hours at the rate agreed for the temp payable for each day of an assignment which is less the 3 hours long.
SBT may vary the rate to be charged for a temp at any time by notifying the Client of the variation.
ENGAGEMENT OF TEMP TO PERM
The placement fee will be on a scale of:
Temp to Perm 6+ months of engagement $0.00
Temp to Perm 3 - 6 months of engagement $250.00 (+GST)
Temp to Perm 1 - 2 months of engagement $750.00 (+GST)
Temp to Perm 1 month or less of engagement as per perm placement fees. (+GST)
If this figure is less than that of "perm placement" the "perm placement" figure will be used.
PAYMENTS
SBT pays the temp employee weekly. Therefore payment of the fee is due within seven days of its submission by the SBT to the Client. If the fee is not paid within seven days of its submission by SBT to the client then the clients shall bear interest thereafter, such interest to accrue from day to day at the rate of 18% per annum. A claim or dispute raised by the Client does not entitle the client to set off or withhold payment of, any money owed to SBT. SBT may withdraw any of its Temp staff on assignment with the Client at any time if the Client does not comply with these Terms and Conditions.
WORK AND SAFTEY
The client will provide the Temp employee with a safe place to work at all times. If the Temp employee is injured whilst working for a Client, the Client will indemnify SBT in respect of any liability resulting from the injury including (but not limited to):
- Any claims brought by the Temp against SBT which arise under common law
- Any penalties imposed on SBT under any Act, Regulation or Delegated legislation including the Health and Safety in Employment Act 1992.
- Any payment to be made by SBT under the Accident Rehabilitation and Compensation and Insurance Act 1992, including any increases in the levies paid by SBT under the Act as a result of the injury or the accident causing he injury.
LIABILITY
SBT makes every effort to ensure that the Client is satisfied with the provision of services under an assignment.
However the Client:
Will supervise, direct and control the Tempt while on Assignment, and:
Is responsible for all acts and omissions of a Temp.
SBT will not be responsible for any loss, damage or expense suffered by the client s resulting from the acts of omissions of a Temp or from any delay or failure by SBT to refer a Temp to the client
The provision of this clause continues to bind the parties after any assignment has ended.
ENTITLEMENT
If a temp employee has worked on a assignment ten working days prior to any statutory holidays and is to return, the client will be invoiced for payment of that /those stat day(s). Pay for stat holidays will be based on the normal hours which would have been worked otherwise a average on the hours worked that week.
GUARANTEE
No charge will be made if a SBT proves unsatisfactory for any reason and SBT is informed within the first three hours of the assignment commencing.
